This session is designed to give attendees an overview of Michigan entrapment doctrine with a particular focus on entrapment arguments in the “Skip the Games” sting cases that have proliferated under the aegis of the Genesee County Sheriff’s Department.

At present, Michigan entrapment doctrine is muddled.

Current doctrine comprises two theories: impermissible inducement and reprehensible police conduct.

“Reprehensible” in this context is a term of art that asks whether police tactics were a proper use of governmental power.

There are viable entrapment arguments in Skip the Games sting cases.

Under Michigan law, entrapment issues are decided by the trial court, not the jury.
